Welcome to Orbitarion. By using our app and services, you agree to these Terms of Service.

1. Acceptance of Terms

By creating an account or using Orbitarion, you agree to be bound by these Terms. If you do not agree, do not use the service.

2. Account

  • You must be at least 13 years old to create an account.
  • One person, one active planet per round. You may not own, control, or play on more than one planet in the same game round, under any circumstances.
  • You are responsible for the security of your account. Never share your login credentials with anyone.
  • Account transfers, sales, or trades are prohibited.
  • We reserve the right to suspend or terminate accounts that violate these terms.

3. Game Rules

3.1 Fair Play

Exploiting bugs, using bots or automation tools, or any form of cheating is prohibited. See section 3.6 for the full cheating definition.

3.2 Multi-Accounting

Owning, controlling, or playing on more than one planet in the same game round is prohibited. Examples include, but are not limited to:

  • Creating a second account while still playing your main
  • Using an alt account as a farm, scout, or resource feeder
  • Logging into another player's account, with or without their permission
  • Coordinating attacks, defense, or scans between two accounts you control
  • Stacking the same alliance with multiple accounts you control
  • Using VPNs, Tor, or proxy networks to circumvent multi-account detection

If you legitimately share a network with another player, see section 3.4 (Shared Households).

3.3 Account Sharing

One account is for one human. Sharing your login credentials with another person — even briefly, even with a friend "to play while you're away" — is prohibited. If we detect distinct individuals using the same account, we may close it.

3.4 Shared Households (Exceptions)

If another player legitimately plays Orbitarion from the same network as you — sibling, partner, roommate, child — you must declare this on our Discord server (#support) before playing competitively in the same round.

Approved households operate under the following restrictions:

  • You may NOT be in the same alliance
  • You may NOT attack each other
  • You may NOT defend each other
  • You may NOT coordinate attacks on the same target
  • You may NOT exchange scan intelligence
  • You may NOT transfer resources, ships, or orbitals

Households who declare in good faith are protected from automated multi-account flags. Households who do not declare risk having all accounts on the network terminated when shared activity is detected.

3.5 Coordinated Transfers

Agreements between players to deliberately lose battles for the purpose of transferring ships, resources, or orbitals are prohibited. Both the giver and the receiver may have their accounts closed.

3.6 Cheating

The following constitute cheating and are grounds for immediate termination:

  • Using bots, scripts, automation tools, or browser extensions to act on your behalf
  • Exploiting bugs instead of reporting them (report via Discord #bugs)
  • Modifying client code, intercepting traffic, or making unauthorized requests to our backend
  • Using VPNs, Tor, or proxy networks to evade detection of any rule violation
  • Attempting to access another player's account by any means

3.7 Harassment

Threatening, harassing, or abusing other players through any channel — in-game, Discord, or otherwise — is prohibited.

3.8 Detection and Enforcement

We monitor login patterns, IP addresses, device fingerprints, and gameplay behavior to detect violations.

Appeals: If you believe your account was closed in error, contact us via Discord (#support) within 14 days. Include your User ID and any context you want considered. Appeals submitted from accounts with evidence of intentional evasion (Tor logins, VPN-hopping during account creation, sequential logins on a shared IP) will be denied.

4. Game Rounds and Resets

  • Orbitarion operates in seasonal rounds. At the end of each round, game data (planets, fleets, resources) is reset.
  • We reserve the right to end, restart, or modify rounds at any time.
  • Account data (email, login credentials, alliance membership) persists between rounds.

5. Premium and Purchases

  • Premium subscriptions provide cosmetic and informational benefits only. No gameplay advantage.
  • Purchases are processed through Apple App Store or Google Play Store, subject to their respective refund policies.
  • We reserve the right to modify premium features at any time.

5.1 EU Consumer Rights and Digital Content Waiver

If you are a consumer resident in the European Union, you have a statutory right under EU Directive 2011/83/EU to withdraw from a contract for digital services within 14 days of purchase.

By purchasing a Premium Commander subscription and confirming that you wish premium features to activate immediately, you expressly consent to the immediate performance of the contract and acknowledge that you lose the right of withdrawal once the subscription becomes active. This is standard for digital subscription services that begin delivering value immediately.

This waiver does not affect your rights to:

  • Cancel the subscription at any time (auto-renewal will stop)
  • Request refunds directly from Apple App Store or Google Play Store under their refund policies
  • Statutory consumer protection rights that cannot be waived by contract under your local law

6. Refunds and Cancellation

6.1 Refunds

Orbitarion (Kaffekullen Interactive) does not directly process refunds for subscription purchases. All refund requests must be directed to the platform you purchased through:

Refund decisions are made by Apple or Google in accordance with their policies. We cannot override these decisions.

6.2 Cancellation

You may cancel your subscription at any time through the platform you purchased from. Cancellation:

  • Stops automatic renewal at the end of your current billing period
  • Allows you to continue using premium features for the remainder of the period you've already paid for
  • Does not entitle you to a partial refund for the unused portion of a paid period

After cancellation and at the end of your current period, your account returns to the free tier. All in-game progress is preserved.

7. User Content

  • Alliance names, planet names, and announcements are user-generated content.
  • You agree not to use offensive, discriminatory, or inappropriate names or messages.
  • We reserve the right to rename or remove inappropriate content without notice.

8. Intellectual Property

  • Orbitarion, including all game mechanics, art, text, and code, is owned by Kaffekullen Interactive.
  • You may not copy, modify, distribute, or reverse engineer any part of the game.

9. Availability

  • We strive to keep Orbitarion available 24/7 but do not guarantee uninterrupted service.
  • Maintenance, updates, and unforeseen issues may cause temporary downtime.
  • We are not liable for any losses due to downtime.

10. Limitation of Liability

Orbitarion is provided "as is" without warranties of any kind. We are not liable for any damages arising from your use of the service, including but not limited to lost game progress, data loss, or service interruptions.

11. Force Majeure

We are not liable for any failure or delay in providing Orbitarion that results from circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters, fires, floods, earthquakes
  • War, terrorism, civil unrest, government actions
  • Internet or telecommunications outages affecting our hosting providers (Supabase, Cloudflare, AWS)
  • Distributed denial-of-service (DDoS) attacks or other malicious cyber activity
  • Acts of public authorities, including data protection regulators
  • Pandemics or other public health crises

12. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions.

Any disputes arising out of or related to these Terms or your use of Orbitarion shall be resolved exclusively in the courts of Sweden, with Jönköping District Court as the court of first instance.

If you are a consumer resident in the European Union, this clause does not deprive you of the protection afforded to you by the mandatory consumer protection provisions of the law of the country in which you reside. You may also have the right to bring proceedings in the courts of your country of residence.

For EU consumer disputes, you may also use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

13. Severability and Entire Agreement

If any provision of these Terms is held to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or severed entirely if modification is not possible. The remaining provisions shall continue in full force and effect.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Kaffekullen Interactive regarding your use of Orbitarion and supersede any prior agreements or understandings.

14. Newsletter and Communications

By creating an Orbitarion account with a verified email address, you may receive occasional newsletter emails about new seasons, game updates, and community announcements. You can unsubscribe at any time using the link in any newsletter email or by emailing [email protected].

Transactional emails (password reset, account verification, subscription receipts, account closure notifications) are necessary for account operation and are not affected by newsletter preferences.

15. Changes to Terms

We may update these Terms from time to time. Continued use of Orbitarion after changes constitutes acceptance of the new Terms.

For material changes, we will:

  • Update the "Last updated" date at the top of this page
  • Post a notice in the app
  • For significant changes, require explicit re-acceptance before continued use
